FanLura — Terms of Service

By accessing or using FanLura (the “Platform,” “we,” “our,” or “us”), you agree to be bound by these Terms of Service (the “Terms”) and all applicable laws. If you do not agree to these Terms, you must not use or access FanLura. We reserve the right to update or modify these Terms at any time. Continued use of the Platform after such changes constitutes your acceptance of the revised Terms.

By using FanLura, you agree that you are at least 13 years old. If you are under the age of 18, you represent that you have permission from a parent or legal guardian to use the Platform. To receive payouts or connect a Stripe account, you must be at least 18 years old and legally authorized to enter into financial agreements.

Users must create an account to upload, purchase, or interact with content on FanLura. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. We may suspend or terminate any account that violates these Terms, provides false information, or engages in fraudulent activity. FanLura allows users to upload, view, and share creative content in compliance with these Terms and any posted guidelines. Users may act as both creators and fans—there are no separate account types. You agree not to use FanLura for unlawful purposes, to violate the rights of others, or to distribute spam, scams, or deceptive content.

All transactions on FanLura are processed securely through Stripe Connect. When a fan purchases content or supports a creator, 90% of the transaction amount is paid to the creator and 10% is retained by FanLura as a platform commission. FanLura does not handle or store credit card information. Payments are subject to Stripe’s own Terms of Service and Privacy Policy. Creators are responsible for ensuring their Stripe account is in good standing and compliant with applicable laws. All payments are final unless otherwise required by law.

Prohibited Content & Safe-Harbor Policy

FanLura is a creative platform intended for general audiences. The following types of content are strictly prohibited and may result in immediate account suspension or termination:

Sexually explicit or pornographic material, sexual acts, or nudity displaying genitals.
Depictions of child exploitation, abuse, self-harm, or violence.
Hate speech, harassment, threats, or promotion of illegal activity.
Content that infringes copyrights, trademarks, or other intellectual-property rights.
Any upload that violates local, state, national, or international law.

Creators are solely responsible for the material they post. Uploading or attempting to distribute prohibited content constitutes a material breach of these Terms.

Platform Responsibility & Safe-Harbor

FanLura hosts user-generated content and does not pre-screen uploads. FanLura and its operators are not liable for prohibited or illegal material posted by users unless they have actual knowledge of such material and fail to act within a reasonable time after discovery. When FanLura becomes aware—through reports, automated detection, or other means—of content that violates this policy, the content will be removed promptly, and associated accounts may be suspended, terminated, or reported to authorities.

Earnings & Payouts

FanLura may withhold, reverse, or cancel any earnings connected to content that violates these Terms. Payouts may be delayed or frozen while moderation or review is in progress. Users found to have uploaded prohibited content forfeit all related earnings.

Refund Policy

Payments made to access or purchase user content are non-refundable except where required by law. If content is later removed for violating this policy, buyers are not entitled to refunds, as FanLura’s role is limited to facilitating creator-fan transactions.

Reporting & Moderation

Users can report content believed to violate this policy. FanLura will review and take appropriate action at its sole discretion. FanLura reserves the right to remove any content, restrict payouts, or terminate accounts without notice to maintain community safety and compliance.

Limitation of Liability

FanLura, its owners, and affiliates shall not be responsible for damages or losses arising from user-generated content, even if such content is later found to be prohibited or illegal, provided that FanLura acted promptly and in good faith upon obtaining knowledge of the violation.

Creators retain ownership of the content they upload to FanLura. By posting content, you grant FanLura a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content solely for the operation and promotion of the Platform. You are solely responsible for ensuring you have all rights and permissions to the content you post.

FanLura may, at its sole discretion, suspend or terminate your account without prior notice if you violate these Terms or engage in conduct that harms the Platform or its community. Upon termination, your access to the Platform and its features will be revoked, but any outstanding payments owed to you (if applicable) will be processed per Stripe’s terms.

FanLura is provided “as is” and “as available.” We make no warranties, express or implied, regarding the reliability, security, or accuracy of the Platform, and we do not guarantee uninterrupted access or error-free operation. To the maximum extent permitted by law, FanLura, its affiliates, and its personnel shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Platform.

Any claim arising out of or related to your use of the Platform must be brought within one (1) year after the cause of action accrues or be forever barred. You further agree that any dispute or claim shall be resolved through binding arbitration under Pennsylvania law, rather than in court, except where prohibited by law.

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict of law principles. You agree that any legal action or proceeding related to your use of FanLura shall be brought exclusively in the courts located in Pennsylvania, USA.

We reserve the right to modify these Terms at any time. Notice of any material changes will be provided via the Platform or email. Continued use of FanLura constitutes acceptance of those changes.
